In Massachusetts, workers cannot sue their employer for a workplace injury but they can get worker’s compensation benefits. You cannot be fired for filing a worker’s compensation claim. This is good news! However, if your boss was already planning on firing you or is laying off people, they can legally fire you. But it has to be for a reason other than you filing for worker’s comp. If they fire you for filing the claim, this is considered retaliatory termination and is illegal!
